KG,), DSV Austria Group (DSV Air & Sea GmbH, DSV Road GmbH) and DSV Switzerland Group (DSV Air & Sea AG, DSV Logistics S.A.) provide a portal for its contractual partners on its website http://www.businesspartner.de.dsv.com (in the following "Businesspartner Portal")

The following Terms of Use govern the use of the Businesspartner Portal:

• Description

  Businesspartner Portal has a protected area which requires registration/login. After successful login the registered user has access to documents which are intended for him.

• Payments

  There will be no charge for the allocation and usage of the Businesspartner Portal. Expanses in relation to the usage of the Businesspartner Portal of the contractual partners, such as but not limited to, acquisition of proper hard- and software, internet usage and administration will not be covered or reimbursed by DSV.

• Access

  Access to the protected area of the Businesspartner Portal is limited to the specific contractual partners determined by DSV, which have to register at the Businesspartner Portal after receiving a registration e-mail. Within the registration the contractual partner has to choose a username as well as a password. For each usage of the Businesspartner Portal the username and password is required. DSV reserves the right to withdraw the access rights subsequently.

• Usage authorization

  The right to use the Business Partner Portal is limited to authorized employees of the above mentioned as well as authorized employees of the contracting parties designated by DSV.
  The aforementioned group of people are only entitled for usage of the Businesspartner Portal within the purpose of the existing business relation. DSV is at any time entitled to specify the duration and scope of the actual access right as well as the general scope of service offered by the Businesspartner Portal.

• Supplier due Diligence

  The contractual partner has to ensure that no unauthorized person has access to the password chosen by the contractual partner. In the event that the contractual partner has knowledge of unauthorized person having access to its password or in the event of a suspicion of misuse the contractual partner shall immediately change its password and inform DSV under compliance@de.dsv.com. In the event of a breach of the aforementioned obligation, such as but not limited to misuse of the login information, DSV reserves the right for blocking the access and initiate further legal actions.

• Liability

  DSV does not take over any guarantee for the availability as well as the correctness of the Businesspartner Portal. Any and all liability shall be excluded in connection with the usage and or the non-availability of the Businesspartner Portal to the extend the damage is not based on wilful intend or gross negligence.

• Trademark

  Trademarks used within the Businesspartner Portal are protected by trademark law. This applies in particular for brands and logos. Any unauthorized or abusive use of these trademarks is prohibited.

• Copyright

  Graphics and texts of the Businesspartner Portal are subjected to copyright law and other protection acts. Within the rightful usage of the Businesspartner Portal rights of use are granted, otherwise the content of the Businesspartner Portal may not be copied, distribute, altered or made available to unauthorized third parties. Furthermore, graphics may be subject to copyrights of third parties.

• Miscellaneous

  These Terms of Use are governed by the laws of Germany with exclusion of its provisions on international private law. Venue for all disputes arising shall be Bremen, Germany.
